A Federal South Dakota Jury Recently Found A Plaintiff’s Ovarian Cancer Was Connected To Her Use of Talcum Baby Powder.

In October of 2013, the first talcum powder ovarian cancer verdict was handed down by a federal jury in South Dakota. The jury found that regular use of Johnson & Johnson talcum powder products over 30 years was linked to the plaintiff’s diagnosis of ovarian cancer.

The jury heard the testimony of an expert on baby powder and ovarian cancer, Daniel Cramer, a Harvard epidemiologist.  Dr. Cramer estimated that of the over 22,000 new cases of ovarian cancer diagnosed in 2013, roughly 10,000 of such cases are causally linked to the perineal dusting of talcum powder.   This jury’s finding supports what some studies have shown and may allow you or a loved one to take legal action against Johnson & Johnson and the talc mining companies Luzenac America and Rio Tinto Materials.

What Is Talc, And Is It Dangerous To The Women Who Use It?

Talc is a mineral containing hydrated magnesium silicate.  The general consumer is most familiar with it in the form of talcum powder.  Less known is that talc is the softest of all known minerals.  For instance, soapstone is largely composed of talc.

Talc also has many industrial uses, including in the manufacture of plastics, paper, and ceramics.  When talc enters the body through intravenous use, it can cause talcosis, a granulomatous inflammation of the lungs.

For many decades, talc has been sold to and used by the general public for use in personal hygiene and cosmetics.  Commonly, women have used the talcum powder for feminine hygiene, applying it to the perineal region.  Talcum powder’s harmful properties have been documented through some studies which date back to 1982.  When talcum powder is applied to the genital region, talc particles travel through the reproductive system to the ovaries where they cause inflammation and may create an environment conducive to the growth of cancerous cells.

Should Women Be Informed About The Risks Associated With The Daily Use Of Talcum Powder Products?

In 2013, the National Cancer Institute (NCI) estimated there were 22,240 new cases of ovarian cancer.  They likewise estimated that 14,030 women would succumb to the disease.  Median age of diagnosis is 63, with 25% diagnosed between the ages of 35 and 54.  At random a women has a 1.37% chance of contracting the disease over a lifetime.  At the 2013 trial in South Dakota a Johnson & Johnson lawyer asserted the company does not have an ovarian cancer label warning on the product because it deems the risk to be insignificant.  However, in that trial Dr. Daniel Cramer, a recognized expert in cancer talcum powder cancer research, estimated that 10,000 cases of ovarian cancer each year can be traced to talcum powder use.   The American Cancer Society estimates that approximately 14,030 women may die from the disease within the year.
